Construction Companies May be Liable for Wages to Contractors under the FLSA

Construction companies may be liable for wages under the Fair Labor Standards Act (FLSA).   In recent months, I have seen more and more construction companies have issues on how they pay their workers.  Many of these companies assume that since they call these workers “independent contractors” or “contractors”, or since they pay these workers on a per diem basis or as their work gets completed, the companies are exempt from the wage and hour requirements of the FLSA.  Such blanket conclusion is not always true and, if wrong, may be fatal.

In Florida, workers are generally not entitled to claim the benefits of an employee if they are employed as independent contractors, or contractors.  However, if looked under the lenses of the FLSA, these workers may arguable have a claim under the FLSA for minimum wage, overtime, or unpaid wages as long as they pass the realities test used by the courts in the 11th Federal Circuit.  Such test mandates that if a worker, regardless of the title he/she has when performing work for a company, passes the realities test used by the court, he/she may be considered an employee under the FLSA and therefore be entitled to minimum wages and overtime pay.

As such, construction companies need to be aware and have a FLSA attorney audit how they pay their workers.
